Approach
My photographs document street scenes, moods and environments. People may appear in the frame, but only as incidental elements of the scene. The intention is artistic and documentary, not to single out individuals.
Rules I apply
- People shown appear incidentally in public space.
- No commercial use of anyone’s image without written permission.
- Upon a motivated request, I review cases and may blur, reframe or unpublish a specific image where proportionate.
Legal context (Belgium)
The right to image derives from the right to privacy (Art. 22 of the Belgian Constitution; Art. 8 ECHR). In public space, when a person is secondary/incidental within a street photograph, consent is not required. Courts balance image rights with freedom of expression/art. Consent is required for advertising/commercial endorsement or if the image harms a person’s dignity.
